Sexual Assault Crimes in Michigan are covered by several Michigan Statues. The most serious sex crime is Criminal Sexual Conduct 1st degree, MCL 750.520b. The penalty for CSC 1st is up to Life imprisonment. A person convicted of this offense is also subject to Life time electronic monitoring tether.
Criminal Sexual Conduct (CSC) in the 2nd degree, MCL 750.520c has the penalty of up to 15 years in prison and may require lifetime electronic tether monitoring.
Criminal Sexual Conduct (CSC) in the 3rd Degree, MCL 750.520d is punishable by up to 15 years in prison.
Criminal Sexual Conduct in the 4th degree, MCL 750.520e is punishable by up to 2 years in prison and is considered a High Court misdemeanor. However it is treated like a felony and requires registration on the Sex offenders registry.
All of the above offenses require registration on the Sex Offenders Registry, MCL 28.723. There are exceptions allowed for registration depending upon the nature of the Sex Crime, age of the actors and consent. This is commonly known as a “Romeo and Juliet” exception where to young actors within 4 years age of each other engage in a sexual act. The exceptions are listed in the applicable statue, MCL 28.723a.
